1. DEFINITIONS

1.1. User: any natural person or legal entity that uses the Application.
1.2. Application: the xFLOWer software published by Click On Hungary Szolgáltató Kft., which enables the User to initiate tasks (cases, tickets), modify them, advance them through workflow stages, close them, and attach documents to them. The Application is designed to support, provide visibility into, and automate the User's office tasks.
1.3. App: the version of the xFLOWer Application optimized for mobile devices.
1.4. Device: any device running the Android, IOS (iPhone), or Windows operating system.
1.5. Parties: the User and the Service Provider collectively.

2. INTRODUCTION

2.1. These General Terms and Conditions (hereinafter: Terms and Conditions) govern the use of the xFLOWer app (hereinafter: App), which can be downloaded and used on both mobile devices and the Windows platform.

3. DESCRIPTION OF THE SERVICE

3.1. The App supports and partially automates business processes and can be used as a standalone application or as a mobile extension of the xFLOWer Process and Document Management System.
3.2. Downloading the App to one device and using it as a single User is free for initiating up to 10 cases per day and managing a maximum of 10 documents. If you need to initiate more cases per day or require access for more Users, please contact Click On Hungary Kft. (https://xflower.hu/). The Service Provider reserves the right to unilaterally change the conditions of free use in the future without separate notice.

4. CONDITIONS OF USE

4.1. By using the Application and/or downloading and using the App, the User accepts these Terms and Conditions.
4.2. The User uses the App entirely at their own risk. The Service Provider accepts no liability for any direct or indirect damage arising from the use of the App.
4.3. When using the App, the User must comply with applicable laws and respect the rights of third parties.

5. LIMITATION OF LIABILITY

5.1. The Service Provider accepts no liability for any damage, including but not limited to direct, indirect, incidental, special, or consequential damage arising from the use of, or inability to use, the Application or App.
5.2. The Service Provider accepts no liability for damage to the User's device or the integrity of their data when using the App.

6. CHANGES TO THE TERMS AND CONDITIONS

6.1. The Service Provider reserves the right to amend these Terms and Conditions at any time without prior notice. Amendments to the Terms and Conditions take effect upon publication.
6.2. The User is responsible for regularly checking for amendments to the Terms and Conditions.

7. CHANGES TO THE SERVICE

7.1. The Service Provider reserves the right to modify or discontinue any feature or service of the App, including the conditions of free use, at any time.
7.2. By continuing to use the App and/or the Application, the User accepts any changes.

8. MISCELLANEOUS PROVISIONS

8.1. These Terms and Conditions are governed by Hungarian law.

8.3. In the event of any legal dispute, the Parties will attempt to resolve the matter amicably. If this is unsuccessful, the Hungarian courts with the requisite subject-matter and territorial jurisdiction will hear the dispute.
8.4. If any provision of these Terms and Conditions is found to be invalid, this will not affect the validity of the remaining provisions.

9. DISCLAIMER OF LIABILITY

9.1. The Service Provider declares that it is not responsible for the accuracy of information entered by the User in the Application. The Service Provider accepts no liability for its completeness, correctness, or any changes to it.
9.2. The Service Provider emphasizes that the data and procedures published in the Application are intended solely for managing individual Cases (tickets, i.e. business processes). Accordingly, pursuant to the relevant provision of the Hungarian Civil Code, the Service Provider excludes in advance its liability for damage arising from any incorrect information in the Application.
9.3 The Service Provider emphasizes that it accepts no liability for damage arising from the use of the Application.
9.4 The Service Provider may modify, update, or suspend the operation of the App at any time without prior notice.
9.5 Changes may occur in the Application beyond the Service Provider's intent or control, and the Service Provider accepts no liability for the accuracy, reliability, timeliness, or substance of the content, information, or other data displayed.
9.6. Users use the Application entirely at their own risk, and the Service Provider is not liable for damage arising from faulty, incorrect, or incomplete content.
9.7. The Service Provider does not guarantee the continuous, error-free operation of the Application's features. The Service Provider accepts no liability for damage, losses, or costs arising from the use of, or inability to use, the Application, its malfunction, failure, or service disruption, computer viruses, connection or system failures, or any other similar cause. The User therefore acknowledges that the Service Provider is not responsible for failures of the User's device, damage caused by viruses, data loss, or unauthorized access to the User's device or network.
